DISTANCE SALE AND USE AGREEMENT

1. PARTIES

2. SUBJECT MATTER OF THE AGREEMENT
This agreement governs the terms and conditions for the use and sale of digital training courses, subscription services, digital internship and experiential programs, certification programs, and all other digital services offered through the SparkGen platform and at
.

3. SERVICE DESCRIPTION
The services offered under SparkGen are as follows:
– Digital educational content
– Digital internship and experiential programs
– Career development programs
– AI-powered feedback
– Verifiable digital certificates
– Subscription-based content access
The seller reserves the right to modify, update, or remove the content of the service at any time.
3.1. Important Notice Regarding Digital Internship and Experience Programs
The digital internship and experience programs on SparkGen are educational programs designed to simulate a real-world work environment and help users develop their career skills. These programs:
– It does not count toward fulfilling the mandatory internship requirement of any institution,
– It does not serve as a substitute for a mandatory or official internship recognized by universities, schools, or government agencies,
– Completing the programs does not entitle the user to work or complete an internship at any employer.
By accepting and acknowledging this, the user becomes a member of the platform.

4. SUBSCRIPTION, TRIAL, AND PAYMENT TERMS
4.1. Subscription Models
SparkGen offers the following access models:
– 1-Month Subscription: This subscription automatically renews monthly. Users can cancel automatic renewal at any time; access continues until the end of the current period, and no charge will be applied for the next period.
– 3-Month Access: A one-time payment is required. There is no automatic renewal.
– 6-Month Access: A one-time payment is required. There is no automatic renewal.
4.2. Free Trial
– A 7-day free trial is available to users who have not previously subscribed to SparkGen Select.
– During trial activation, 0.10 TL (10 Kuruş) will be charged for card verification; this amount is non-refundable.
– Full access to all premium content is provided during the trial period.
– If automatic renewal is not canceled before the trial period ends, the applicable fee will be automatically charged based on the selected plan:
– For the 1-Month plan: The monthly fee will continue to be automatically charged each period.
– For the 3-Month plan: A one-time fee for 3 months is charged, after which automatic renewal stops.
– For the 6-Month plan: A one-time fee for 6 months is charged, after which automatic renewal stops.
– Users can cancel automatic renewal at any time during the trial period; in this case, no fee will be charged at the end of the trial period, and access to
will end.
4.3. Automatic Renewal
– For a 1-month subscription, automatic renewal charges will be billed to the registered card at the start of each billing period until the user explicitly cancels it.
– If automatic renewal is not canceled for trial subscriptions, the fee for all plans (1-, 3-, and 6-month) will be automatically charged at the end of the trial period.
– Users can turn off auto-renewal at any time from the Subscription Management page in their account.
– Subscriptions for which auto-renewal has been canceled remain active until the end of the current billing period.
4.4. Payment Failure
If payment cannot be processed during automatic renewal, the system will retry for up to 10 days. If payment is not processed within this period, the subscription at
will be canceled. Users can start a new subscription at any time.

5. DELIVERY AND ACCESS
Digital services are activated immediately upon payment confirmation. Users access the services through their own accounts.

6. RIGHT OF WITHDRAWAL
In accordance with the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, since access to digital content at
begins as soon as the user completes payment, the user is deemed to have expressly waived the right of withdrawal and cannot exercise that right.
By completing the payment step, the user agrees to this waiver.

7. RETURNS AND CANCELLATIONS
– No refunds are issued for digital services where access has already begun.
– The 0.10 TL charged for card verification is non-refundable.
– In the event of a technical error or the inability to provide the service, the Seller reserves the right to offer the user an extension of equivalent duration or a refund.
– Subscription cancellations must be made before the start of the next billing period; fees already collected for the current period are non-refundable.

8. USER OBLIGATIONS
User:
– Is responsible for account security,
– May not share the services with third parties,
– May not use the services in violation of the law,
– Is fully responsible for the content uploaded to the platform.

9. ACCOUNT SUSPENSION AND TERMINATION
The seller reserves the right to suspend or permanently close a user's account in the following circumstances:
– Use in violation of the Agreement
– System abuse
– Illegal activities

10. CERTIFICATE AND CONTENT LIABILITY
– Certificates are documents of achievement indicating that the user has completed the relevant program; they do not guarantee employment or an internship.
– Training courses and programs are intended for informational and professional development purposes; they do not guarantee a specific career outcome.
– The user uses the certificate at their own risk.

11. INTELLECTUAL PROPERTY
All content, images, software, and materials on the platform are the property of the Seller; they may not be copied, distributed, or used for commercial purposes on
without permission.

12. THIRD-PARTY SERVICES
The Seller is not liable for any disruptions caused by third-party services, such as the payment infrastructure or artificial intelligence services, used on the platform.

13. TECHNICAL ISSUES AND ACCESS
The provider may temporarily suspend the service for technical reasons. For access issues arising outside of scheduled maintenance and mandatory outages, the user may be granted an equivalent extension of the
service period.

14. LIMITATION OF LIABILITY
The seller's liability is limited to the total amount paid by the user for the relevant service.

15. PERSONAL DATA
Personal data is processed in accordance with the Personal Data Protection Law No. 6698. Please review our Privacy Policy for details.

16. RIGHT TO AMENDMENTS
The seller reserves the right to modify the terms of the contract and the scope of services, provided that such changes are communicated in advance. Changes will be announced on the platform.

17. DISPUTE
The laws of the Republic of Turkey apply. In the event of a dispute, the courts and consumer arbitration boards of the Republic of Turkey have jurisdiction.

18. ENFORCEMENT
By checking the box “I have read and accept the terms and conditions” during the payment step, the user declares that they have read, understood, and accepted all the provisions of this agreement
