DISTANCE SALE AND USE AGREEMENT

1. THE PARTIES

Any natural or legal person who is a member of the platform and/or purchases services

2. SUBJECT MATTER OF THE AGREEMENT

This agreement governs the terms and conditions for the use and sale of digital training courses, subscription services, business simulations, certification programs, and all related services offered through the SparkGen platform.

3. SERVICE DESCRIPTION

Services offered under the SparkGen program:

    • Digital educational content
    • Business simulations
    • Internship and career programs
    • AI-powered feedback
    • Verifiable certificates
    • Subscription-based content access

The seller reserves the right to modify, update, or remove the content of the service at any time.

4. Subscription and Payment Terms

    • Services can be offered through a subscription or a one-time purchase model.
    • Cancelled subscriptions remain valid until the end of the current billing period.

5. DELIVERY AND ACCESS

    • Digital services are activated after payment.
    • The user accesses the services through their own account.

6. RIGHT OF WITHDRAWAL

For digital content, there is no right of withdrawal due to the immediate nature of the service.

7. Returns and Cancellations

    • No refunds are issued for used digital services.
    • Technical issues are reviewed by the Seller.

8. USER OBLIGATIONS

User:

    • is responsible for account security
    • You may not share the services with third parties
    • You may not use it in violation of the law
    • He is fully responsible for the content he uploads to the platform

9. ACCOUNT SUSPENSION AND TERMINATION

The seller reserves the right to suspend or permanently close a user account in the following circumstances:

    • Use in violation of the contract
    • System abuse
    • Illegal activities

10. CERTIFICATION AND CONTENT LIABILITY

    • Certificates are a measure of achievement; they do not guarantee employment.
    • The user uses the certificate at their own risk.
    • The training sessions are for informational purposes only; no results are guaranteed.

11. INTELLECTUAL PROPERTY

All content belongs to the Seller and may not be used without permission.

12. THIRD-PARTY SERVICES

The Seller is not responsible for any disruptions caused by third-party services used on the platform.

13. TECHNICAL ISSUES AND ACCESS

The provider may temporarily suspend the service for technical reasons. This suspension may last up to 120 days. The periods during which the user cannot access the service are considered additional usage time.

14. LIMIT OF LIABILITY

The seller's liability is limited to the total service fee paid by the user.

15. PERSONAL DATA

Personal data is processed in accordance with the Personal Data Protection Law.

16. RIGHT TO AMEND

The seller reserves the right to modify the contract and services.

17. DISPUTE

The courts of the Republic of Turkey have jurisdiction.

18. ENFORCEMENT

By accepting this agreement, the user brings it into effect.
