SPARKGEN TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the SparkGen website, platform, digital experience and internship programs, content, features, and related services (collectively, the “Services”).

By accessing or using SparkGen, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Services.

1. Parties

These Terms apply between SparkGen (“SparkGen,” “we,” “us,” or “our”) and any visitor, registered user, participant, or other person accessing or using the Services (“User,” “you,” or “your”).

2. Description of the Services

SparkGen is an online career development platform offering digital experience and internship programs, AI-powered features, business simulations, educational content, and career development tools.

Through SparkGen, Users may participate in programs, complete tasks and real-world projects, develop practical skills, gain experience across different fields, receive feedback, and earn certificates upon completing eligible programs.

SparkGen experiences are designed to complement traditional internships and do not automatically constitute or replace internships required by an educational institution, employer, or applicable law.

3. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You must not:

  • Attempt to manipulate, disrupt, or interfere with the operation of the platform
  • Upload malicious software, harmful code, or other potentially damaging content
  • Attempt to bypass security measures or access restricted areas of the platform
  • Access another User’s account without authorization
  • Impersonate another person or organization
  • Submit fraudulent, misleading, or intentionally inaccurate information
  • Copy, reproduce, distribute, or commercially exploit SparkGen content without authorization
  • Use the Services in a way that could negatively affect the security, availability, or experience of other Users

SparkGen reserves the right to suspend, restrict, or terminate an account if we reasonably believe that a User has violated these Terms or misused the Services.

4. Artificial Intelligence

SparkGen may use artificial intelligence and automated technologies to analyze User activities, submissions, and program participation and to provide feedback, recommendations, assessments, or other features.

AI-generated outputs are provided for informational and educational purposes and may not always be accurate, complete, or suitable for a particular purpose. Users should exercise their own judgment when relying on AI-generated information.

SparkGen does not guarantee that AI-generated outputs will be 100% accurate or error-free.

5. Account and Security

Certain features of SparkGen may require you to create an account.

You are responsible for:

  • Providing accurate and up-to-date account information
  • Keeping your login credentials confidential
  • Taking reasonable steps to protect your account
  • Not allowing unauthorized individuals to access your account

You should notify SparkGen promptly if you believe that your account has been accessed or used without authorization.

6. Content and Intellectual Property

All content made available through the SparkGen Services, including but not limited to text, graphics, designs, software, branding, logos, educational materials, program structures, simulations, and other materials, is owned by SparkGen or used under appropriate licenses.

Unless expressly permitted by SparkGen or applicable law, you may not copy, reproduce, modify, distribute, publish, sell, license, reverse engineer, or commercially exploit SparkGen content.

Participation in a SparkGen program does not transfer ownership of SparkGen’s intellectual property to the User.

7. User Submissions

Users may submit assignments, responses, project work, files, feedback, or other materials through the platform (“User Content”).

You retain ownership of your User Content, subject to any rights granted to SparkGen that are necessary to operate, provide, improve, and secure the Services.

You are responsible for ensuring that your submissions do not violate the rights of third parties or applicable laws.

8. Certificates and Program Completion

Where applicable, SparkGen may issue certificates to Users who successfully complete eligible programs.

Certificates may include verification features such as QR codes or verification links.

Receiving a SparkGen certificate does not represent a guarantee of employment, admission to an educational institution, or any other specific career outcome.

9. Third-Party Services and Companies

Certain SparkGen programs may involve real companies, external platforms, tools, or third-party services.

SparkGen may not control the availability, policies, content, or performance of third-party services. Users may be required to comply with the terms and policies of those third parties when using their services.

Participation in a SparkGen program does not guarantee employment, an internship offer, an interview, or any other opportunity with a participating company.

10. Service Availability

SparkGen aims to maintain reliable and secure Services but does not guarantee that the platform will always be available, uninterrupted, or error-free.

We may temporarily suspend or modify parts of the Services for maintenance, security, upgrades, technical issues, or other operational reasons.

11. Modifications to the Services and Terms

SparkGen may modify, update, suspend, or discontinue any part of the Services at any time.

We may also update these Terms from time to time to reflect changes in our Services, business practices, technology, or legal requirements.

The updated version will be published on the platform with a revised “Last Updated” date. Your continued use of the Services after an update constitutes acceptance of the revised Terms, where permitted by applicable law.

12. Disclaimer of Warranties

The Services are provided on an “as available” and “as is” basis, to the extent permitted by applicable law.

SparkGen does not guarantee that:

  • The Services will always be available or uninterrupted
  • All platform content or information will always be accurate or complete
  • Participation in a program will result in employment, an internship, or any specific career outcome
  • AI-generated outputs will always be accurate or error-free
  • A certificate will be accepted by every employer or educational institution

Users are responsible for their own decisions and use of information obtained through the Services.

13. Limitation of Liability

To the maximum extent permitted by applicable law, SparkGen will not be liable for indirect, incidental, consequential, special, or other losses arising from or related to your use of, or inability to use, the Services.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is not permitted under applicable law.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the applicable laws governing SparkGen and its Services, without prejudice to any mandatory rights or protections available to Users under the laws applicable to them.
